Pedestrian Killed in Accident Near Roswell

A pedestrian was killed after being hit by a vehicle on U.S. Highway 185. New Mexico State Police responded to the accident near Roswell around 1:30 a.m. on December 2.

Thirty-five-year-old John Chavez was walking on the southbound lanes of 285 when a 2019 Freightliner Commercial Motor Vehicle hit him. The driver of the commercial motor vehicle was a forty-eight-year-old man from Albuquerque.

New Mexico State Police pronounced Chavez dead at the scene. The first investigation showed that the driver didn’t sustain any injuries and that alcohol wasn’t a factor in the crash. The investigation continues.

Pedestrian accidents are especially harsh because people are directly exposed to the hit of a big vehicle. Even if the driver isn’t speeding, the impact can force the person to the ground where most of the injuries occur.

You can be the most careful driver who is focused on the road and still end up in such an accident. In many accidents like this one, the pedestrians are carrying part of the liability.

Wearing dark clothes at night, crossing the street at an unmarked crosswalk, or trying to cross the street in oncoming traffic can be some of the reasons for these accidents.

If you were involved in an accident like this, where you hit a person with your vehicle, you’ll need a skilled attorney. They should prepare a strong defense for you, otherwise, the penalties would be quite challenging.

Be sure to stay at the scene and try to help the person. Call an ambulance and the police. No matter how the accident happened, make sure you don’t apologize or explain whose fault it was. Wait for your New Mexico criminal defense attorney‘s guidance. The police will investigate the accident and it may show a completely different outcome than what you thought.
